South Africa'S Water Allocation Crisis: Scarcity, Equity and the Limits of Reform

South Africa has allocated over 98% of its available water resources, and the Department of Water and Sanitation projects a 17% national supply deficit by 2030.

With conventional surface water sources near full use, the country's water challenge is no longer primarily about finding new supply — it is about who holds existing allocations, whether infrastructure can deliver them, and how a legal system built for redistribution can be made to work in practice. South Africa is a water-scarce country by any measure. Its average rainfall of 450 mm per year is half the world average, compounded by an evaporation rate of 2,000 to over 2,600 mm per year. Renewable water resources stand at approximately 900 cubic metres per capita per year — a figure classified as water scarce by international standards. Scarcity is driven not only by physical endowment but by recurrent droughts intensified by climatic variation, localised population growth and high per-capita consumption. SETTLED: Lawfulness of Johannesburg's Free Basic Water policy and prepaid meters (2009)
The Constitutional Court unanimously held in Mazibuko v City of Johannesburg (8 October 2009) that the City's policy of providing six kilolitres of free water per household per month and installing prepaid meters in Phiri was lawful and reasonable under section 27 of the Constitution and the Water Services Act.
